Hereinafter referred to as "the Company," "Owner," or "TRP Cars."

1. Binding Electronic Agreement & Legal Compliance

By clicking "I AGREE" or "ACCEPT," you enter into a legally binding contract recognized under Nigerian law, including the Nigerian Evidence Act 2011 and the Cybercrime Act 2015. This digital agreement constitutes your electronic signature and is equally enforceable as a handwritten signature.

2. Acceptance of Vehicle "As Is" with Road Conditions Disclaimer

You acknowledge renting the Vehicle "AS IS" with full knowledge of Nigeria's specific road conditions and challenges. The Company makes NO WARRANTIES regarding the Vehicle's suitability for:

• Nigerian federal, state, or untarred roads
• Seasonal flooding conditions
• Inadequate street lighting
• Unmarked road hazards, potholes, or road construction
• Military or police checkpoints
• Areas with poor telecommunications network coverage

3. Nigeria-Specific Scenarios of Absolute Renter Liability

You accept SOLE AND ABSOLUTE LIABILITY for the following:

A. Security & Terrorism-Related Incidents

• Kidnapping for ransom
• Carjacking or armed robbery
• Vehicle seizure by militants or unknown gunmen
• Theft of Vehicle parts while parked
• Damage from mob action or civil unrest

B. Official & Unofficial Checkpoint Interactions

• Any demands, fines, or "settlements" requested by police, military, FRSC, VIO, or other security personnel
• Confiscation of Vehicle by government agencies
• Damage or injury at checkpoints
• Loss of personal items or documents during searches

C. Infrastructure & Environmental Hazards

• Flood damage during rainy season
• Damage from open manholes or road erosion
• Theft or damage while parked at unsecured spaces
• Damage from falling trees, electric poles, or building materials
• Damage from harmattan dust, heat, or weather conditions
• Collisions with livestock

D. Fuel & Maintenance Issues

• Engine damage from adulterated fuel
• Mechanical failure due to counterfeit spare parts
• Breakdown in areas without towing or mechanic services
• Damage from incorrect fuel type

E. Third-Party Services & Fraud

• Fraudulent activities by any driver or passenger
• Theft by hotel staff, car wash attendants, or service providers
• Damage during repairs at unauthorized workshops

4. Absolutely Prohibited Uses

• Transportation of illegal goods
• Human trafficking
• Ritual activities or transporting human remains
• Use as an ambulance or hearse
• Use for courier or commercial transport
• Transportation of hazardous materials
• Use for off-road racing, driving schools, or towing
• Transportation of live animals (except approved pets)
• Crossing international borders without approval
• Use in states under security advisory or travel restriction

5. Extended Indemnification

• Claims from family, heirs, or assigns
• Claims from employer or business associates
• Passengers in the Vehicle
• Other motorists, pedestrians, or property owners
• Law enforcement or government agencies

6. Nigerian Legal Proceedings Undertaking

• Appear personally in Nigerian courts or police stations
• Bear all costs for Company legal representation
• Not seek out-of-court settlements without consent
• Pay ₦250,000 per day for "loss of use"
• Reimburse full vehicle value if impounded

7. Enugu State Specific Provisions

• Understand Enugu's traffic and security considerations
• Responsible for parking violations in Enugu metropolitan area

8. Total Financial Responsibility Declaration

• Total replacement cost of Vehicle
• Loss of business revenue during repair/replacement
• All legal costs
• Reputational damage compensation

9. Total Loss, Theft, or Irreparable Damage

CRITICAL CLAUSE: Immediate payment of full market value if Vehicle is stolen, hijacked, unrecoverable, or damaged uneconomically. Report incidents within 2 hours.

10. Complete Release & Indemnity of Company

You fully release TRP Cars and affiliates from any and all claims. Agree to defend, indemnify, and hold harmless the Company for all rental consequences.

11. Mandatory Final Acceptance & Nigeria-Specific Declarations

• Confirm awareness of Nigeria's security, road, and social conditions
• No TRP Cars employee can override these terms
• Accept all inherent risks of renting in Nigeria
• Will not involve Company in family or traditional dispute resolutions
• Confirm no medical/mental conditions impairing driving
• Vehicle personally inspected or knowingly waived

12. Post-Acceptance Display & Record Keeping

YOUR ACCEPTANCE HAS BEEN RECORDED. YOU HAVE LEGALLY AGREED TO BE SOLELY LIABLE FOR ALL RISKS, INCLUDING THEFT, ACCIDENTS, AND CRIMINAL ACTIVITY, AND TO PAY THE FULL VALUE OF THE VEHICLE IF IT IS STOLEN OR DAMAGED BEYOND REPAIR. PROCEEDING TO PAYMENT CONFIRMS YOUR FINANCIAL COMMITMENT TO THESE TERMS.
